Rent Heavy Equipment

1. Equipment Use & Responsibility

The renter agrees to use all equipment for lawful purposes only and in accordance with manufacturer guidelines. Any misuse, abuse, or unauthorized modification of equipment is strictly prohibited and may result in termination of the rental agreement without refund.

2. Rental Period & Scheduling

All rental periods are subject to equipment availability and admin approval. SW Trading Corp reserves the right to reschedule or cancel appointments due to unforeseen circumstances, including equipment maintenance or force majeure events. The client will be notified promptly in such cases.

3. Deposit & Payment Terms

A refundable security deposit may be required prior to equipment release. Final rental rates will be confirmed upon approval of the request. Payment must be settled before equipment is released from the SW Trading facility.

4. Liability & Insurance

The renter assumes full liability for any damage, loss, or theft of equipment during the rental period. SW Trading Corp strongly recommends that renters secure appropriate insurance coverage. The company is not liable for any indirect or consequential damages arising from equipment use.

5. Equipment Condition & Return

Equipment must be returned in the same condition it was released, subject to normal wear and tear. The renter is responsible for all costs associated with repair of damage beyond normal wear. Late returns will incur additional charges at the standard daily rate.

6. Operator Qualification

The renter warrants that all operators of the rented equipment hold valid licenses and certifications as required by Philippine law (RA 4136 and applicable DOLE/OSHC regulations). SW Trading Corp is not liable for accidents resulting from unqualified operation.

7. Site Conditions

The renter is responsible for ensuring that the project site is accessible and suitable for the equipment. SW Trading Corp shall not be held liable for damages to property, infrastructure, or persons at the delivery site.

8. Cancellation Policy

Cancellations made at least 48 hours before the scheduled appointment will be processed without penalty. Cancellations within 48 hours may forfeit the deposit. No-shows will be charged the full first-day rate.

9. Privacy & Data Use

Personal information collected during the booking process is used solely for the purpose of processing rental requests and communicating with the renter. SW Trading Corp complies with the Data Privacy Act of 2012 (RA 10173) and will not share your data with third parties without consent.

10. Governing Law

This agreement shall be governed by the laws of the Republic of the Philippines. Any disputes arising from this agreement shall be subject to the jurisdiction of the appropriate courts in Quezon City, Metro Manila.
